Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Customer") and A1-Soft ("Company", "we", "us") regarding your use of the WhatsAPI Pro platform and all related services, APIs, and tools.

Description of Service

WhatsAPI Pro provides a platform that enables businesses to connect to the official Meta WhatsApp Business API, send and receive WhatsApp messages programmatically, manage instances and bulk messaging campaigns, and integrate WhatsApp messaging into third-party applications via webhooks.

The Service is intended for legitimate business communication purposes only.

Account Registration & Security

• Provide truthful, current, and complete information during registration.
• Keep your account credentials confidential at all times.
• Notify us immediately of any unauthorized use of your account.
• Be solely responsible for all activities that occur under your account.
• Not share your API keys or access tokens with unauthorized third parties.

Acceptable Use Policy

The following activities are strictly prohibited:

• Sending unsolicited bulk messages (spam) to users who have not opted in.
• Sending messages containing illegal content, hate speech, harassment, or threats.
• Using the platform for phishing, fraud, or any deceptive practices.
• Sending messages that violate Meta's WhatsApp Business Platform Policies.
• Attempting to bypass rate limits, quotas, or other technical restrictions.
• Reverse engineering, decompiling, or disassembling any component of the Service.
• Reselling or sublicensing API access without written permission from A1-Soft.

WhatsApp Business Platform Compliance

• Comply with Meta's WhatsApp Business Platform Terms of Service at all times.
• Obtain proper opt-in consent from recipients before sending marketing messages.
• Only send approved message templates for outbound conversations.
• Respect recipient opt-out requests promptly.
• Maintain message quality ratings required by Meta.

A1-Soft is not responsible for account suspensions imposed by Meta due to policy violations by the customer.

Subscription Plans & Billing

By subscribing, you agree to pay all applicable fees, provide accurate billing information, and understand that subscription fees are billed in advance and are non-refundable except as required by law.

We reserve the right to modify pricing with 30 days advance notice. In addition to our platform fees, Meta charges per-message fees billed directly through your Meta Business Account.

Service Availability

We target 99% monthly uptime for our core platform. Service disruptions caused by Meta or other third parties are outside our control. We are not liable for losses resulting from service downtime or API unavailability.

Intellectual Property

All intellectual property rights in WhatsAPI Pro, including the platform software, user interface, documentation, branding, and API specifications, are owned by A1-Soft or its licensors. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for internal business purposes only.

Limitation of Liability

To the maximum extent permitted by applicable law, A1-Soft shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid to us in the three months preceding the claim.

Termination

• By You: Cancel your subscription at any time. Access continues until the end of the paid billing period.
• By Us: We may suspend or terminate your account immediately for violation of these Terms or non-payment.
• Upon termination, your data will be retained for 30 days before deletion.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Kuwait. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Kuwait.
